Updates From AISPA - Ashok Bahirwani (4 Sept. 2011)

I was once again watching the video of the Headlines Today report on the Supreme Court matter of the 2nd September, 2011. I am really pained at the way the channel has reported this entire matter in a malicious and provocative manner.

No Supreme court Judge can ever make such prima facie observations like “You have defrauded thousands of people” and “Investigations against you must continue”.

WHY? Because as of today there is not even a single charge sheet filed against the company (SAOL). Further Headlines Today reported that the Hon. Supreme Court had “dismissed” Saol’s petition where as the fact of the matter is that the petitioners (SAOL) had on their own will “withdrawn their petition”. In Law there is a very big difference between these two terms.

The withdrawal of petition by the companies (SAOL) counsel was a strategic move to keep their route in the Hon. Supreme Court alive.
It is the hallmark of an experienced Counsel to quickly gauge the mood of the Bench.
It is unbelievable, a blatant lie by the channel, to even suggest that the Hon. Supreme Court can make such an observation. The Order of the Hon. Supreme Court is in the public domain and everybody can see the same.

Nowhere in that Order has the court made any Observation or passed any order even close to what the channel has reported. This constitutes contempt of Court of the highest order.

AISPA is going to strongly lodge a protest against this misreporting, I did not want to disturb our Associations Counsel Mr. Adv. Ahmad Abdiji it being a Sunday, but by tomorrow evening I will surely lodge a complaint against the channel in the right forum as may be advised by our counsel.

There were reports that a rogue site speakasiaassociation.in has surfaced claiming to be the official website of AISPA. I want to refute this and place on record that this site is no way connected with AISPA. We are looking at the possibility of serving them with legal notices. AISPA will keep you updated of the events as they unfold.
