Good Evening Speak Asians

End of yet another anxious and suspense filled day. Once again, a day of mixed responses we had some setbacks, we saw some huge success and there was no news from some sectors.

We all know that this is an uphill task and we are in the midst of a fierce war. It is important that the victory is sweet when the WAR is fierce is no achievement in winning over a weak adversary.

Before I go on to report on the day’s events let me openly state the fact that whenever a case gets highlighted as the case of SAOL has been, the return to normalization takes time, there is no magic want that solve the problem in one day.

There was no news from Delhi, the application of the company which has been moved the Hon. Supreme Court, did not get listed today.
Allow me to explain what will be achieved by this application before the Hon. Supreme court.

• The company has prayed in its application before the Hon. Supreme court, that all matter related to the SAOL case be transferred under one single investigating agency for investigation.
• The investigation, be ordered to be completed in a set time frame, and pending such investigation, No further arrests of anybody connected to SAOL i.e. SAOL officials, Speakasian Panelists, and the SAOL franchisees, be allowed.
• We faced a reversal in the Hon. High Court at Hyderabad, where the Hon. High court quashed the company’s petition against the PIL and transferred the matter to the state CID for investigation.
• The Hon. High Court at quashed out plea because a body called “Corporate Fraud Watch Society” brought to the notice of the court that fresh FIR’s had been filed by a few panelists in Andhra Pradesh.
• I URGE AND SINCERELY APPEL TO ALL SPEAKASIANS “Kulhaadi apne pair par mat maaro, yaaro” Filling of fresh FIR’s will not help anybody. No court, No CID, No EOW, No FIR, can return or ensure of your monies save and except the company SAOL. If you understand this 90% of our problems will be over.

All the complaints against the company or the franchisees or their up lines are behaving like the proverbial “ghar ka bhaidee… Lankaa dhaaye”.

AISPA is fighting for you, the power of force of combined 20 lakh voices is always going to be more powerful then a single FIR or a single complaint.

The media once again reported the matter in a deploringly negative manner and went on say that the court has ordered the CID to effect arrests of all concerned.

This act is tantamount to the highest degree of contempt of court but alas this is the level of deterioration of journalism standards and alas we common people of India do not have the courage to take up this fight to bring these “yellow” journalist’s to book.

The GOOD NEWS I want to share with all Speakasian friends is that your website www.aispa. co.in in had over 16,00,000 views by 7:00pm in the evening this is a great confirmation of the continued support of TRUE SPEAKASIANS in favor of our beloved company SAOL.

This is crucial phase in our war, the enemy is waiting for us Speakasians to lose patience and open up our flanks for them to attack us. They do not know we are all united strongly because we Speakasians are one huge family, this is what they never imagined, and “Sarforoshi ki tammana ab humare dil mein hai…. Dekh na hai zor kitna bazoin kaatil mein hain”.

Speak Asia Latest updates as on 30/08/2011

Dear Speak Asians,

At this critical point of time when the fierce battle is going on in legal arena when not many concrete updates are coming we would like to provide you with following news which should keep you away from any rumor:

1. As lot of rumor is going on that the COO Mr. Tarak Bajpayee has been released on bail by Supreme court on 29/08/2011 is not true. We have authentic information from the official SAOL sources that nothing of that sort has happened. Though he is expected to get the anticipatory bail very soon which will stop all the arrest apprehensions from across India by various state police in similar cases.

2. The control of the website www.speakasiaonline.com is still not with the SAOL management so only panelists are facing problems which are pure technical in nature. There is nothing to panic because of website not being functioning properly because as soon as we get some relief on the battle field of the law correcting a website is peanut.

3. There are hearing of cases going on in various courts of laws in India related to SAOL and till now nothing has been proved against of Speak Asia in any court of law. Any learned person in India knows very well that any court would not deliver its judgement merely based upon negative campaigning by media against any entity. It will go through each and every fine detail of the facts before delivering the final judgement. Looking at the current scenario of SAOL case victory in court is sure but no one in this world can give a date.

4. Speak Asia Panelists Association (AISPA) has filed a PIL (Public Interest Litigation) before the Honorable High Court at Mumbai which is now posted for 7th September, 2011, when the Government of Maharashtra is to file its reply. Apart from this some of the panelists have independently moved the Honorable Supreme court and are in the process of filing a PIL before the Supreme Court asking for ad interim relief and requested that the money which is seized by the authorities in India be brought under the custody of the Supreme court and under its supervision be distributed among the panelists.

5. As per our official sources we can expect some critical and probably good news on the legal front in this week. So stay tuned with only reliable media and do not pay attention to rumors and for god shake you don't join the people who spread rumors for cheap publicity of themselves and play with the emotions of millions of innocent investors across our country.

Hello Speakasians,

First of all I wish to strongly object and protest against the administrators of speakindiaonline for banning me from the site. And they call themselves the only independent media (sic).

Nobody will be able to stop the voice of 20lakh panelist’s.

Once our problems are solved and we come back, we the panelists will remember who tried to stall us, and which panelists’ put our lives’ and livelihood in danger.

Being a Sunday my entire day was spent in creating and adding material for our upcoming site www.aispa.co.in, and planning for a major press conference that we intend to hold by the end of this week or latest early next week.

I ran a campaign on facebook, on various pages, supportive of speakasia, and on the page SpeakAsia Powers... , an idea germinated by Mr. Arun Khandelwal, the slogan or tagline of your Association was finalized as “Speak… Empowerment”

Before I go any further let me address one major problem many Speakasians are facing is about the Technical Problem the SAOL site is facing, allow me to put to rest your concerns.

This is purely a Technical Problem and unfortunately cannot be rectified immediately as the Administrative Rights rest with the EOW as of now. The EOW has not completed the investigation of the portal/site.

Once our COO Shri Tarak Bajpai, is released I am sure he will first stake claim on the return of the SAOL portal/site.

Besides this major issue there have been many unsubstantiated rumors doing the rounds to which I wish to once again reiterate that till the company’s own channels of communication are restored you please have faith in the updates provided by me as secretary of AISPA.

In regard to the press conference I have made a presentation to the president of the Press Club of India as below:

Dear Sir,

Sir, I am sure you must have heard of the Speakasia controversy which is being reported in a negative and one-sided manner by the media.

Please allow me to place before you the story from the affected 20 lakhs panelists’ view point.

* February/March 2010 Speakasiaonline Pte. Ltd. (SAOL) a company registered in Singapore starts its operation in India.
* SAOL starts their operation as a survey based company, in its first or its launch phase, and its tag line was “We Value your Opinion”
* Because of the unique idea combined with aggressive field support from the company, SAOL grew at a phenomenon speed and in short time of less than a year SAOL panel size grew to a whopping 20 lakh panelists.
* The huge size of the SAOL family along with a pan India presence spread over every demographic possible made it the biggest provider of survey panels on the international panel exchanges.
* All the panelists have always been paid promptly and regularly by the company till the 12th May, 2011, after that the bank accounts were closed by the company bankers M/s United Overseas Bank, Singapore, on 27th May, 2011 probably due to the cautionary circular sent out by the RBI vide circular No. DBS.CO.PPD No.16237/11.01.005/2010-11 dated 23rd May, 2011.
* SAOL has been approaching the RBI and various other appropriate agencies to seek permission for establishing their PE and for restarting the operations and restarting the payments to their panelists (us).
* An Individual not connected to SAOL filed a criminal PIL in the Mumbai high court against the Government of Maharashtra, seeking directions to the police to set up a suitable mechanism to avoid any sort of internet fraud to safeguard gullible small time investors.
* The Hon. High Court presided by her ladyship Justice Ranjana Desai was pleased to instruct the EOW to file their affidavit on the mechanism in place to safeguard the investors. She had made some observations which were prime facie observations not in any way pointing to the SAOL.
* The EOW erred in their interpretation of the Hon. Ladyship and started investigating SAOL with a vengeance. The investigation arises out of a FIR filed by one Mr. Khosla, who has been a panelist of the company and has been regularly getting paid by the company till the bank accounts were closed in May, 2011.
* Some FIRs have been filed by few aggrieved panelists all over the country. It is not the case of any complainant that they have not received payments before the bank account was unfortunately closed down.
* SAOL is on record and are committed to restart the payments as soon as the banking channels are restored.
* This sudden stoppage of operations and stoppage of payments of SAOL has adversely affected us the 20 lakh Indians who are the panelists of the company.

‎* All the 20 lakh Panelists had joined the business module to enhance their earnings and see a positive change in their living standards and until May 2011 have experienced the fruits of this association many of whom have experienced a total positive change in their life style.
* It has been almost three months since the monies have freezed up and still all the panelists (barring a few who have complained) are patiently waiting and support the company’s endeavor to get out of the problems and restart the operations.
* The present Association is formed, based and arising, out of support E mails received from all over the country.
* AISPA has filed a PIL before the Hon. High Court at Mumbai. Which is now posted for 7th September, 2011, When the Government of Maharashtra is to file its reply.
* Some of the panelists have independently moved the Supreme court and are in the process of filing a PIL before the Hon. * Important to note here that between 9th May and 11th May, 2011 SAOL organized one of the biggest consumer gathering under the name and style of Gen X held in Baga, Goa.
* Gen X saw various reputed brands like, Provouge, Reebok, Gitanjali jewellery, American Tourister, Samsonite, IFB Electronics, Flying Machine, TVC skyshop, and Skoda Automobiles to name a few, display their wares for the Speakasians to purchase. A whopping over Rs. 4 to 5 crores were transacted in one day of shopping making it a record single day shopping record.
* The end of Gen X was to usher in the company’s ambitious second phase and the tag line now is “Consumer empowerment”
* The company has grown from being a survey based company and is now into as they call the 5th ‘P’ of marketing i.e. PRECISION MASS MARKETING.
* This second phase was to unleash a revolutionary phase where the company was planning to use this humongous size of its panelists and use their purchasing power to provide the panelists with international quality of products at prizes which were half of what these products are presently available at.
* We the Panelists feel that because of the unprecedented success of the company and its unveiling of its revolutionary new product based platform, has sent jitters in the trade in general and caught the envy of the company’s competitors.
* This unknown enemy of the company is presently orchestrating and unleashing a vicious and malicious negative campaign against the company.
* The Architect of the campaign against the company has unknowingly harmed the interest of 20 lakh Indians and has affected lakhs of marginal players whose kitchen fires were being run on the earnings they received from SAOL.
* The stoppage of the legitimate operations of SAOL has in fact violated the basic fundamental right of each individual “The right to livelihood”

Sir, In light of the above submissions I on behalf of the Association request you to provide us an opportunity to meet your good selves where we can show you the relevant documents etc.

This week starting tomorrow is a crucial week for SAOL and out futures and as and when things happen I will dutifully report to you.

Please do not ask me what is going to happen in this week, because, I am abstained by legal counsel. This is in the best interest of us and our company SAOL.

But be assured that strong steps are being taken by high ranking legal counsel.

Pray that this week we get good news. SAOL has not cheated us upto today it is the government agencies which are refusing to hear SAOL. But for how long? In the final analysis Law will prevail. “satya meva jayete”

Good Evening Speakasians,

Under advice of our legal counsel i have been advised not to discuss the matter of Mr. Tarak Bajpai’s release.

I would like to assure you, that Tarak Sahib and SAOL are being represented by TOP legal luminaries who will ensure a rightful culmination of this entire matter. You have to realize that this a public forum and we cannot discuss strategy here.

Today your Association first met some high ranking journalists who were willing to lend us a friendly ear and advice us on how to tackle the negativity of the press towards SAOL.
Mr. John Varghese, Panelist, helped us with his contacts in the media. They have advised us on how to go about the entire process to find some positive space in the media. Your Association will soon be taking these steps and I will inform you all as they unfold.

The next part of the day was spent with the Sub Committee (Media) consisting of Mr. Aman Azad (responsible for all the videos that you see on the site) Mr. Vikalp Shrivastava (who came down from Pune in very heavy rains, along with the Web Designer) Mr. Devesh Shah, Kohei, and Mr. and Mrs. Roshini Arora, who is a software professional herself. (Roshiniji very graciously helped my wife serve tea and snacks in our long meeting of five hours)

Mr. Melwyn Crasto, our President presided over both the meetings, tirelessly with his calmness and wisdom. After all he is a certified Sensei

In consultation with the committee office bearers we have now handed over the project of
“WEB Designing with WEB application development & hosting solutions”

Very Soon our website will be up and it will be an authenticated virtual space where you will receive the latest updates on SAOL and where you can post your questions and resolve your problems.

Once our company rises above the problems that we are facing, this website will act as a direct interface between the company and the panelists.

Speakasians please remember that we do not have any complaint against our company SAOL which have always given timely payments and through various forums interacted with us directly to create this moral strength—‘which is the speakasia family’.

If the EOW had any substantial case against SAOL the courts would have extended police custody to Tarak Sahib and other officials.

The very fact that the Hon. Magistrate at the Esplanade Court (Quila court) granted unconditional bail and later the Hon. Magistrate at the Thane Court granted unconditional bail on surety of a meager Rs. 25000/- without giving further police custody stands testament to the fact that EOW has not been able to convince these courts of a prima facie case against SAOL.

I have heard that some panelists across India are in the process of filing FIRs, in favour of the company, against the ORIGINAL COMPLAINANTS of the company, on the following grounds:

Malicious intent.
Conspiracy against the company.
Human Right violation.

I urge all such panelists who are taking this counter attack position please do not open up such fronts.
We are ethical associates of an ethical international company we do not believe in such negative combat.
Speakasians! We are not afraid; we will fight everybody who comes in our way.

We are fighting silently, and loudly, and we will approach every forum, from our local corporator, MLA, MP Upto the Hon. Supreme Court. The voice of this 20 lakh strong Speakasian family will surely be heard.

Crystal Clear Information about SAOL

One of the Speakasian Ravi Ranjan’s amazing reply to Mr. Neeraj Borgaonkar: I’m writing a note here which will give you more crystal & clear info along with replies to all your queires.

It seems that Mr. Neeraj Borgaonkar has lots of queries and confusions too. May be other panelists who are supporting or not supporting SAOL having these queries in their mind too. I havnt commented yet on anyone’s but have watched all questions & answers. I am joining this page first time as I am also a True Speakasian. FYI, I have all updates of SAOL. So, after seeing my contents, more confusion should be resolved.

My contents are in such a manner that all the asked queries will be answered automatically.

Before raising any questions regarding SAOL business model etc. you must know why SAOL facing problems. In today’s market, all other MLM companies, got registered in India & are running their businesses. Do you understand it, WHY?

FYI, the answer of all problems is only one. What is that? Can you guess?

SAOL has neither paid any bribe to any media, any politician, any personality nor having any political support. If SAOL would have paid to media channel & these corrupt politicians before GenX Bazar then SAOL would have got positive coverage on GenX Bazar & would have got PE, other things on time. What I have revealed here is not known to all. Only few people, who are very close to the company’s people, know this. SAOL had announced that in Genx Bazar, media coverage will be there & everything will be published on facebook too. Do you understand why this did not happen & the day, GenX was going on, Star News started airing all negativity. Here, do not ask me how much money had been asked to telecast GenX and to speak in favour of SAOL. Everyone must know that media never favours anything unless or until, there is direct or indirect profit lies.

Do you know the name of that politician who has started campaign against SAOL with media Channel? He is Mr. Somaiyya. Do you know why he is doing this? A close relative of him running NMart. NMart owner’s name is Mr. Shekhawat. He has very strong support of one of BJP’s top leaders. He has openly said in a public meeting that he will destroy SAOL. Try to understand, why these people are totally against SAOL. Because, the business model / concept of SAOL is very powerful. SAOL’s concept create multiple earning opportunities for all. SAOL entering into Advertising world which has endless opportunities. Once SAOL will be in full flow then its growth will be the fastest. All unsuccessful networkers started joining SAOL & started earning good kind of income.

In a nutshell, SAOL is not only a business, this is a revolution.

@Neeraj Borgaonkar’s queries..my ans:

1. whether SAOL having other source of income except panelist subscription amount or not, this is company’s internal matter. company always saying to all press and others that if they sign NDA (Non-Disclosure Agreement), then SAOL will disclose its client list. And, after you must be knowing that EOW Mumbai not found anything substantial against SAOL. It means, on this point SAOL is strong.

2. In recent development, while hearing a PIL, High Court has recently asked RBI, why RBI is not allowing SAOL to pay to their Panelists though SAOL wants to pay to their panelist. RBI has been asked to reply within a week (this happened yesterday only).

3. SAOL is taking services of one of the best law firms in India. So, nothing to worry. And we all are able to see the results that after enquiry of 18 days, EOW Mumbai has not found anything substantial. It means, our lawyers helping a lot to prepare strong defence of SAOL.

4. No one is there to listen to SAOL business model. Everyone wants money as bribe. All of us knowing that other companies are coming with the same concept and getting registered in India without any objections, neither from media nor from any politician. The reason is Money only. SAOL did only one mistake and that is not getting registered before or on time.

5. FYI, we are not investors of SAOL and SAOL not providing any shares in the market, so SAOL is not entitled to show its balance sheet to its panelists. BTW, SAOL has already shown and submitted its balance sheet and Income Tax Report to the concerned authorities while investigations and we all know this.

6. SAOL charging for subcribing an ezine and along with two surveys every week. Ezine’s contents is very educative and provide rich and useful information about the products/services, the survey is based on. Ezine is charged as nothing in this world is FREE.

7. You must agree that when physical survey is done in the market, only 10% data is being expected as genuine, rest is expected as filled up by the same persons who is moving door to door. Now, its online age and approaching people to fill up the surveys becoming easy. Three Ids funda is not a prob in genuiness. It may be possible that one person purchasing three ids in his name only but surveys in all three ids getting filled up by three different person in his family. And if, all three ids surveys getting filled up the same person and same feedback in all three then also company is getting atleast one opinion from one person. You must understand one thing, if you do not allow somebody to get profit in referral business, then he/she will not be interested more in your project. This is business ethics.

8. It is already assumed that at any case 100% genuine opinion cant get whether it is offline or online survey. Generally people fill up the genuine things because these surveys are very easy to understand and fill up. And these are almost realted to our day to day basis activities or general products and services we are using. So definitely, company is getting good genuine responses. May be some of them must be fake. Mind you one thing. Survey industry is very old and very important as well. No one can get 100% genuine survey data. It is understood.

9. When Mr. Tarak Bajpai will be free then he will start working for getting registered with ROC, getting PE and payout. If the owner of the company, Ms. Kaur comes to India, she will be arrested on the same day as it tried with Mr. Manoj’s (CEO, SAOL) wife. Becasue our anti people know that SAOL is very strong on legal matter with pefect paper work and in court you are able to know the result also. So, these anti people who are strong politician only trying to influence EOW of different states to arrest all top officials of SAOL , just to linger on the proceeding to get any PE or something. They think, these type of happening will create panic among panelists and in that case more and more panelist will come with FIR and this way more and more problem will be there for SAOL and for all of us. So, the owner of SAOL and CEO of SAOL are trying their level best to get the things resolved. If they come now then there will be no hope further for SAOL. Try to understand it.

10. SAOL is not allowed right now to do any Press Conference by authorities.

It was not revealed before that EOW of other states are also in queue to arrest Mr. Bajpai. It had been revealed only when Thane EOW did. So, now, our lawyer decided to take an anticipatory bail directly from Supreme court to prevent these arrest so that Mr. Bajpai gets free and can do something for panelists and for SAOL itself. Right now, SAOL need a person like Mr. Bajpai into the market to resolve every issues.

Good Evening Speakasians,

After many days, a day, full of GOOD NEWS. After many days we had multiple successes and I take immense pride in reporting as follows.

GOOD NEWS #1: Mr. Rahul Shah the poor victim of the high handedness of the Authorities and an example of subversion of facts was today released on bail, by the Quila Court. To quote the companies Counsel Adv. Ponda this was “A classical example of picking up a wrong man in a wrong case”.

The faith of 20 lakh panelists has once again been imposed in the legal system when the Hon. Magistrate Esplanade Court released, Mr. Rahul Shah, employee of M/s Tulsiyant Info, a company no way connected to SAOL, on bail. Details of the order are awaited; I will post the details ASAP.

GOOD NEWS #2: Mr. Tarak Bajpai our inspirational leader and beloved COO along with the other three officials, none of whom is a SAOL official, were granted unconditional Bail, by the Magistrate in the Thane Court on a surety of Rs. 25000/- only per head. This order was pronounced in court only around 6.00 pm and as such our COO and the three others will have to spend yet another uneasy night on the floors of Thane Jail.

My heart bleeds to see this man who has led the speakasian family to great heights, who has been the architect of change in the standard of living of lakhs of families, sleeping on the floors of Thane Jail, fighting for the panelists, and still smiling.

TRIVIA:

1. The Domain name of your Association website has been confirmed and hopefully the site should be operational within the next 7 to 10 days.

2. The initial proposal of the PR agency has been received and has been circulated amongst the committee members for their opinion and suggestions. We should be able to finalise this soon and the panelists should see the PR exercise taking shape soon. I will share with you the details as they keep getting firmed up.

3. The Association has mooted the idea of setting up a call centre for better verbal communication with the large panelist family.



RUMOURS & UNSUBSTANTIATED REPORTS:

Without going into the details of the forum or the website where the stories were germinated, I attempt to clarify on “HOT” news items of the day.



SAOL has started paying their employees: A false statement to the core, without starting payment of the panelist the company will not pay the employees. All the employees are willing to stand by the company along with their leader Shri. Tarak Bajpai. The company is duty bound to first pay the Panelists followed by the vendors and finally the employees.
The State Government is going to go in appeal against the order of Mr. Tarak Bajpai and others bail order: This is a normal action in the legal process. An aggrieved party will always appeal to the next available medium available to them. So this does not come as a surprise to me as this is the established route available to the authorities.
Zee news report on Mr. Moilly referring the matter of SAOL to SFIO:

I have not seen this news item and as such cannot substantiate the same.

Allow me to comment on this tomorrow, I would like to study this in detail.



As is evident from the above we are moving in the right direction. Things are happening in our favour. On such a large scale, with Govt. Authorities involved we cannot decide the speed, but we can smell victory.

Hello friends, Fellow Speakasians,

Today was a rather slow day compared to to the hectic activity over the last 10 days.

The Magistrate at the Thane Court was on leave today and as such the bail order of Mr. Tarak Sahab has now been kept for Orders Tomorrow i.e 26th August, 2011. We definitely hope for the best.

The Association's Website Domain name has been registered, we are awaiting confirmation, i will share with all of you the domain address tomorrow.

We have had a lengthy discussion with a PR agency to put out a PR exercise in the public domain to counter the negative and malicious campiagn being propagated by the media. We all can see the orchestrated effort of the unknown powerfull corrupt enemy. For example todays report in the TOI refused to mention that a PIL has been admitted on behalf of 20 lakh speakasia panelists and is being heard alongside the earlier criminal PIL. A reporter would have to be BLIND and DEAF not to notice this.

I have been pained by how various people in their enthusiasm report rumours as if they were the absolute truth. Friends the press is already doing that work of reporting unsubstantiated news. The least we as speakasians can do is not report rumours as authenticated news.

Like i said it was a rather slow day and hence a short update.

Updates Of PIL Submitted By AISAPA

Dear Speak Asians

As u All know that today was a hearing on PIL submitted by AISAPA so these are the updates of the same as follows :-

1.Hon High court ordered to RBI,MCA and Roc to Submit there report in 14 days this is a good news for us.
2.RBI have to answer that why they freeze the account of SAOL and if they will not give the suitable answer then RBI have to defreeze the account of SAOL and have to give permission to pay the panelists.
3.The Hon High court ordered to EOW to submit there final report of investigation in 10 days.
4. The Next hearing date is 7th SEP .

So Be positive result will be in our favor.

Good Evening Speakasians,

Hello Friends,

Today has been a day of mixed responses but summed up i would say a step ahead in the positive direction.

The day started with the hearing of the PIL which is now being heard along with the earlier criminal PIL filed against the Govt. of Maharashtra that had accused SAOL as being on the verge of committing fraud on lakhs of innocent investors in what they preferred to call a net based fraud.



Without Prejudice i attempt to reduce in writing what i understood from the proceedings, I understood that the Hon. Judges clearly said that they are not at all suggesting or wanting the EOW to investigate SAOL individually, infact the court is interested to understand the preparedness of the agency to counter any attempt to defraud the gullible indian investor in any sort of cyber fraud.



The court wanted to understand in detail the procedure to file complaints with the EOW and the systems in place with the EOW like cyber forensics to investigate and to prevent any sort of cyber economic crime.



The court was clear and prounced in the court their main concern was to safe guard the interest of small and marginal investors.



The Associations Advocate Mr. Ahmad Abdi prayed before the Hon. Court for immediate ad interim releif by way that the over Rs. 130 crores seized by the Authorities be deposited with the Hon Court to be held by the court till the same could be disbursed amongst the panelists.



The Company's Advocate Mr. Abaad Ponda requested the Hon. Court that an opportunity be given to the company to defend itself before being termed scamsters.

He even pointed out to the court that how the EOW was misusing the observation made by the Hon. Ladyship, when she had simply made a prima facie observation in the matter, as if it was an order and placed it before various judicial forums while opposing the bail application of the accused (SAOL officials and others).

The advocates of the company urged the Hon. Court to comment that the police investigate the matter independently without taking into account the Hon. Courts observations as earlier passed. The Hon. Court was pleased to make the following observation: : "The police should investigate the matter independently".

This is not an ad verbatim recording of the obeservation but is close to it in letter and spirit.

After hearing all concerned the court was pleased to instruct the Govt. Of Maharashtra to reply to the post in the next two weeks, and the matter is now posted after two weeks.

We then rushed to to the Thane court where the Bail Application was preponed from tommorow to today.

The Magistrate heard the bail applictaion, but reserved her order till tommorow as the Investigating Officer of the EOW Bhayander was not available today.

The matter is now posted for tommorow for orders.

We hope and pray that all will be well tomorrow.



My Assessment:

In legal tussels like this matters move painstanigily slowly. As i see things are moving in the right direction and once again my trust on the Indian judiciary is ********.

As i see it we will start hearing things in our favour, and within a week from today we will hear news in our favour.

We have set up a sub committee (Media) who will be primarily responsible for the launch of the Association's Website as soon as possible.

The Sub Committee members are as follows:

The sub Committee is, as of now, open to add on more members.

The Duties of the Sub Committee members will include:

• Design and Launch of the Website.
• Regularly updating the website.
• Moderating the chat forum when it is enabled on the website.
• Coordinating with the media.
• To develop and add content for the website

There was a large gathering outside the Magistrate court in the matter of the release of Mr. Tarak Bajpai's and three others.

The Magistrate was pleased to send  Mr.Tarak Bajpai and the other Three into Judicial Custody.

The Matter is now posted for hearing the Bail Application on Thursday i.e 25th August, 2011.

It is important to note here that Mr. Bajpai is the only one who is the empoyee of SAOL. While Mr. Mehrotra and Mr. Jain are both officials of M/s Tulsiyat Tek Pvt. Ltd. while the fourth Mr. Sarkar is merely a speakasia Panelist.

Earlier we got news that the Association's PIL had been admitted by the Hon. Chief Justice of the Hon. High court and was now clubbed along with the earlier PIL. The hearing on this PIL is now slated today in the High Court.

The PIL filed at Hyderabad which was posted for hearing on 23rd August, 2011 is now Adjourned to Saturday i.e 27th August, 2011.

Mr.Tarak Bajpai our inspirational leader on his way to the jail made the following statement.

" Ok, everybody is fighting including me for all the panelist, just stay patient for some time. We are bound to win and we will definately win"

Hats off to our COO and his ever cool demeanour imagine being in custody for over 25 days now and he is still out there motivating his panelist.

This is the true measure of an inspirational leader and we have all witnessed his dynamism in the past.

In my assessment its only a matter of few more days and everybody is going to see things turning positive again.

I understand that the company is moving the Supreme Court to get protection from such malicious and misguided FIR's.

HELLO MY DEAR SPEAK ASIANS ,

Today was a very busy day and i attempt to report as follows:

It started with my Meeting with the Associations Council Mr. Ahmad Abdiji we had a long conference on various issues.

We discussed in detail the present situation and the route ahead.

We discussed that the PIL filed by the Association on Saturday i.e. 20th August, 2011 will now be mentioned before the Chief Justice of the Mumbai High court for admission tomorrow morning at 11.00am.
We hope that the Associations PIL as filed on 20th August 2011 be heard by and along with the earlier criminal PIL.
We, have agreed, and decided that a RTI application, be filed before the relevant RBI authorities, with the following details.

Date: 14th July, 2011.

The honorable lordships in their order dated 14th July, 2011. Had opined in their order on page 5 para 6 line 2 as follows:

Relevant Extract:

“However in the interest of fairness, an opportunity should be granted to the petitioners to submit a representation to the Reserve Bank. Sub section (2) of section 35A of the Banking Regulation Act, 1949 does in fact contemplate the making of such representation.”

The lordships further in line 11 go on to add as follows:

“We accordingly dispose of this petition by permitting the petitioners to place representations on the record of the Chief General Manager of the Reserve Bank of India, who had issued the circular dated 23rd May, 2011. In the event that such a representation is made, we would expect the Reserve Bank of India to make a decision in accordance with law. The Reserve Bank of India may furnish an opportunity to the petitioners to explain the contents of the representation in a meeting which may be convened for that purpose”.

The question for the RTI may arise as follows:

Has the Chief General Manager, RBI been approached by the company Speakasiaonline pte. Ltd. if yes when?
If Yes, Has the chief General Manager, RBI given an opportunity to the said company to present their business module?
What was the reason?, on what grounds?, what was the causative action which forced the Chief General Manager to issue the circular dated 23rd May, 2011?
Has the meeting been convened as the lordships ordered?

Friends, this is the broad outline and grounds for the RTI application.
My advice to all of you is that please arrange proper legal councils, spend money, and get good experienced advocates on board.

Your Committee then met some members of an NGO’s supporting the human rights of people in Maharashtra and made a presentation to them on how lakhs of people who depended solely on the income generated from the SAOL module have been robbed of their legitimate right to earn. By this malicious campaign they have been robbed of the opportunity to their livelihood and respectful existence.
The Committee Members then met and decided on the following steps for the immediate future over the next couple of days:
Immediate focus is to seek our COO’s Release.
We need to see that the Associations PIL is admitted tomorrow.
The associations PIL has to be clubbed with the initial PIL and should be heard along with the original PIL.
To Launch the Associations own Website thereby providing an Authenticated Forum for the Panelists.
To register the association and open the Bank Accounts.
The resultant outcome of the hearing of the PIL hopefully on Wednesday i.e. 24th August, 2011 will decide our future course of action.

As an aside, I wish to mention here that the immediate pre operative expenses are being borne by the office bearers and the committee members on an individual basis. But going forward we may require monetary support from the speakasian family, and we are in the process under advice of legal counsel, deciding how to go about it.
It will not be out of place to mention here that the legal fees of our counsel Adv. Ahmad Abdiji has been paid by your Office bearer by individual cheques.
Tomorrows Agenda is as follows

Early Morning meeting of the core committee for E support and website development.
Attending the Thane Court where Tarak Sahibs Bail application will be heard.
Meeting PR agency to discuss PR activity to fight negative campaign.
Collate, and putting material together for Wednesday PIL hearing.

SAOL Current Situation, Way Ahead, Todays Updates.

Hello Friends,
We are all anxious to know about many things, the most important being the once listed below:

• When Will the Payouts Start?

This is a million dollar question and I am sure almost all the panelists including me are eagerly waiting for the payments to restart. I wish to draw your attention to the fact that the company has been approaching the RBI on various occasions but the pleas have fallen on deaf ears and the required permissions have not come through. Our Global CEO Ms. Haren Kaur has written to RBI once again on 19^th August, 2011 and we again await some positive response.
I wish to draw your attention to The PIL filed by your Association before the Hon. High Court at Mumbai wherein one of the main prayers is that the RBI be instructed to withdraw the circular issued by them to all banks cautioning the banks against speakasia. It is also prayed that the company be allowed to pay out over 200000 Speakasians whose requests are pending for payment.

In summation I wish to submit that come Wednesday 24^th August, 2011 this question will be better answered once the Hon. High Court has heard the PIL.

• When will the Surveys restart?

We are all aware that the servers of the company are being investigated by the EOW. This is the reason why the portal is not fully operational.
As soon as the EOW finishes the investigation they will hand over the portal back to SAOL and the surveys and the EXIT option will be activated.
The PIL of your Association pleads before the Hon. High Court to fix a time frame for the authorities to complete investigations of the company.
Once again this question will be clarified after the hearing of the PIL.

• When will the PE be established?

This question will also be answered after the hearing of the PIL filed by your Association on Wednesday i.e. the 24^th August, 2011.

• Where is our CEO Mr. Manoj Kumar and our Global CEO Ms. Haren Kaur?

Friends both of them are safe and sound and monitoring the entire defence operation in all probabilities. I am sure they have not returned to India on the advice of their Legal counsel.
We should be hearing from them soon. Maybe they are waiting for things to get clarified in the matter of Tarak Sahibs detention matter.

• Why is our COO Mr. Tarak Bajpai being arrested again and again?

Mr. Tarak Bajpai was first arrested on 29^th July, 2011 under the FIR resulting out of the order passed by the Hon. High Court in the criminal PIL filed sometime in July 2011. After serving the mandatory 14 days remand Mr. Bajpai was finally released on Bail Yesterday i.e. 20^th August, 2011.
Once Mr. Tarak Bajpai was a free man he was once again arrested in yet another FIR filed at Mira Road by the EOW Bhayander.
To counter this menace of multiple complaints in, if at all, one crime against SAOL the company management is in a huddle with their legal team.
On enquiries, SAOL have assured us that they will soon find a remedy to this, and put a stop to this menace which is becoming a huge irritant in the way of getting final release of our COO Mr. Tarak Bajpai.

Friends, fellow Speakasians we have to understand the gravity of the situation and assess the situation that we are currently in REALISTICALLY.
The matter is in the hands of various Govt. Agencies and they will work at their own speed, maybe purposely at a snail’s speed. This is why we introduced the PIL to speeden them up.
We have no choice but to be UNITED & PATIENT. This is the ONLY way we will WIN.
On a positive note I would like to inform you that Mrs. Renu Sharma wife of our CEO Mr. Manoj Kumar Sharma, was released from detention without being arrested, yesterday itself, because they could not find any reason or case against her, which in itself is a huge testimony to the fact that the EOW has not got any substantial material against SAOL.

Tarak Bajpai Released Some Important Updates

After getting bail from Mumbai High court, Tarak Bajpai has taken some steps-

1. SpeakAsia has asked RBI again to permit the remittance of Payments (dated 19th August 2011)

2. He is already informed that the website will be hand over to SAOL management with in Few days.

3. Speak Asia is trying to get the YUG products from port.

4. Top leaders and the Speak Asia panelist associations are going to meet with Tarak Bajpai.

5. All panelist are awaiting for getting the due payments, that is why, SAOL management are trying to get the RBI, EoW clearance for PE, which is in LOOP.

6. Tarak Bajpai will give a positive news (via Presentation) to all panelist but he is awaiting for Green signal from the RBI and EoW. He is not allowed to organise any meeting or presentation right now.

7. Mrs. Heren and Manoj Kumar are planning to come back to India if her lawyers allow her to come back from Dubai.

8. They are not allowed to permit payout before PE.

9. No New Investigation is required by EoW, but they are expecting POSITIVE news from High Court.
