Updates From AISPA - Ashok Bahirwani (17 Sept. 2011)

Good Evening Speakasians,

While interacting with scores of panelists on the ‘Contact us’ page on Aispa, I have come to realize that majority of the panelists still want to know of only the basic issues as follows:

• When will Surveys start?
• When will Payouts start?
• When will EXIT OPTION payments start?

I attempt to answer their anxiety and concerns as follows:

Nobody can give a time frame to such things especially when the matter is sub-judice.

The company is moving on all fronts to seek a quick resolution of the problem and fast normalization of the company activities.

As we all know that the company is being investigated by the EOW.

The Company website is under the custody of the EOW and they are investigating the matter.

Once the EOW is through their investigation the website will be returned to the company.

Only after return of the website, will the operations on the website restart, including surveys, viewing our wallets and the RP’s, till then we will have to remain patient and united.

The company is on record to say that this is the phase where they are collecting data of panelists interested in opting for the exit option. They will simultaneously approach the RBI to seek permission for affecting the PAYOUTS.

The company has further clarified, that they are also contemplating, to deposit the money with the designated courts, or any competent authority for further disbursement to the panelists.

The only thing worth to note is that the company is fighting tooth and nail with the authorities.

We need to be patient and have faith in the company.

Sorry, no time line can be set, but be rest assured that the company is not wasting any time and hopes to solve this problem at the earliest possible.

The very fact, that the company has not vanished into thin air, and on the contrary, hired topnotch law firms to represent their case in the courts, should reassure all of us.

Panelists across the country are now pinning their hopes on 21st September, 2011 which is the next date of the Association’s PIL in the Mumbai High Court, and they ask me what will happen in the hearing on the 21st.

Let me make it clear to all the panelists, that the matter is not in any way posted for any hearing, the matter is posted on 21st for the respondents i.e. the Govt. of Maharashtra, RBI, The Union Of India and SAOL to file their reply. Considering that they indeed file their reply on the 21st then we will have to file our rejoinder (our reply to their reply). Having said this, our counsels will surely try to press once again, and pray before the Hon. High court, that ‘Ad Interim relief’ be given to the petitioners meaning the Association, by safeguarding the payouts due to the panelists.

In the earlier Criminal PIL against the Govt. of Maharashtra, the EOW has been asked to file their affidavit detailing the preparedness of the state in preventing cyber crime. Besides this, the EOW has to submit their report on the meeting with the Addl. Commissioner (Crime), with the forensic expert who had preferred an intervening application on the last date.

In both the matters there are no arguments expected.

Save and except the prayer of the Associations counsel no other move is expected in the Associations PIL.

I hope you are all aware that in the Writ in the Supreme Court the respondents are to file their reply before the 24th September, 2011 and the actual hearing is scheduled for the 10th October, 2011.

Yesterday, i.e. 16th September, 2011, the panelists in Delhi who have filed the WRIT PETITION in the Supreme Court, had held a Press Conference, and according to reports, it was a positive interaction with the press, and they have managed to put across to the press the view point of the panelists.

Your Association is also organizing a press conference on Monday, i.e. the 19th September, 2011, at the Mumbai Press Club, Mumbai, where we hope to put across the Panelists view point before the media.

Let us all hope and pray that the view point of 20 lakh panelist citizens is indeed put forth in the public domain without any malice and in an unbiased manner.
