Good Evenings Speakasians,

While returning home from an important meeting with the Associations Advocates I was working out this update in my mind and I had made up my mind on updating all the panelists about the current position viz a viz various legal matters.

I read this saying posted on the message board of the very famous and pious St. Michaels Church, Mahim.

“Fairness is really what justice is”
The entire family of Speakasian’s are law abiding citizens and have implicit faith in the judicial system of India and indeed in its fairness.

I am going to list out all the legal matters in which the company is involved and their present status:

1. VIJAYAWADA MATTER:

This was the first matter filed against the company. It is important to note here that an NGO by the name “corporate fraud watch” is very active in Andhra Pradesh and has been in the forefront in their fight against all network marketing companies.
This NGO is also embroiled in a legal battle with AMWAY.

This NGO believes that all networking companies are fraudulent in nature and intent. You cannot stop people from having their opinion in independent India.

 The current status in this case is that the four accused who were arrested namely:

a) Mr. Dipankar Sarkar who is a simple panelist just like you and me.

b) Mr. Rayees who is an ordinary employee of the company (SAOL).

c) Mr. Ravi Khanna who is again not an employee of the company.

d) Mr. Rahul Shah this poor gentleman is in no way connected to any company even remotely connected with any operation of SAOL and the company counsel Mr. Ponda has gone on record before the Hon. Magistrate in the Esplanade court (Quila Court) and termed his arrest as “picking up a wrong man in a wrong case”. He told the court in Marathi that the authorities are doing whatever they wish without any application of mind.

  All the above four have been released on bail yesterday by the Vijayawada Court.
Also pertinent to note here is that all the accounts of the franchisees of SAOL were freezed under this Vijayawada matter.

2. FIRST PIL IN MUMBAI HIGH COURT:

An individual in no way connected to SAOL filed a criminal PIL in the Mumbai High Court against the Government of Maharashtra.

The main prayer of the PIL was that the petitioner wanted to know of the preparedness of the authorities in preventing internet fraud and cyber crime. The petitioner’s case was not against SAOL per se, although the petitioner maliciously drew on Speakasia as an example. We all know of the reach and power of our adversary so we can understand how an uninterested petitioner could be easily influenced to implicate SAOL. It is easy to hurl aspersions on everything.

History is witness to how people have even accused our sacred ‘Sita Mata’.

Pertinent to note here is that the Hon. High Court never ordered the Mumbai police (EOW) to investigate SAOL under this PIL they simply asked the EOW to submit a report on the preparedness of the police in preventing cyber crime or internet fraud (which the EOW has failed till date to file).

The overzealous officials of the EOW do the easiest thing available; they target a soft and vulnerable target SAOL, and start investigating this company to make this a showcase example.

The Hon High Court has at a later date, on the prayer of the companies (SAOL) Counsel Mr. Ponda even, observed that the court has in no way ordered the authorities to Investigate the company SAOL and that the EOW needs to investigate this matter independently.

But alas who is to explain unbiased independence.

 We the panelists have unflinching faith in the fairness of the EOW and indeed in the Judiciary “Satyamev Jayate”.

3. The EOW Case:

A panelist going by the name of Mr. Khosla files a FIR on 28th July, 2011 at Bandra East Police Station. 

The Matter is transferred to EOW and showing great urgency the EOW officials arrested Mr. Tarak Bajpai form his residence in Indore in the middle of the night on 28th itself
The EOW has charged the accused i.e.:

a) Mr. Tarak Bajpai COO of SAOL.

b) Mr. Rajeev Mehrotra of M/s Tulsiyant Tech.

c) Mr. Ravi Khanna of M/s Tulsiyant Tech.

d) Mr. Dipankar Sarkar Panelist form Raipur.

e) Mr. Rayees Tech Team SAOL

The investigations are undergoing and all the persons arrested in this case are released on bail.

The company website www.speakasiaonline.com is under the custody of EOW for investigation under this case. The EOW has upto 27th October, 2011 to file their charge sheet (90 days from arrest).

4. The Mira Road Case:

This is an interesting case in point, on how the authorities are hell bent on harassing the company officials and how the only resolve evident is to delay the normalization of the company’s activities.

The case stems from a panelists complaint against its direct up line (Sponsor) the above mentioned persons in the EOW case are not even mentioned in the FIR. Surprisingly the panelist in question Mr. Dipankar Sarkar is not anywhere in the picture in this transaction.

Showing no respect for law or the process the EOW Bhayander without application of mind arrested the four above mentioned persons (except Mr. Rayees) as soon as they were released from the Arthur Road jail on 20th August, 2011.

Pertinent to note here is that the Hon. Magistrate at the Quila Court had disallowed the Transit remand application moved by the EOW Bhayander for the custody of the above mentioned persons.

All the persons arrested under this case have been released on bail.

5. PIL Filed by AISPA in Mumbai High Court:
Upon its formation, the first thing the Association (AISPA) did was to move the Hon. High Court Mumbai and filed a Public Interest Litigation (PIL) putting forth the view point of the 20 lakh Panelists.

The respondents in this matter are:

a) Union of India through Secretary Finance, Govt. of India.

b) Reserve Bank of India, Mumbai

c) State of Maharashtra through its chief Secretary

d) Speakasia online Pte. Ltd. Singapore.

Besides other issues the PIL made the following Prayer before the Hon. High Court as follows:

i. To examine the records based on which the RBI has issued the impugned circular dated May, 23, 2011 and after examining the same to quash and/or set aside the impugned circular.

ii. To direct respondents No. 1 & 2 to complete the investigation into the affairs of the company in a time bound manner as fixed by the Hon. Court.

iii. That pending the investigation the respondents No’s 1 and 2 be directed to allow the company to make payments to their panelists and allow the EXIT OPTION

The Matter is now kept on 12th October, 2011 for the respondents to file their reply.

6. Writ Petition filed by some Panelists in the Supreme Court:
We know a campaign was undertaken by some panelists of sending VAKALATNAMAS to file a WRIT PETITION in the Supreme Court.

The WRIT PETITION was filed by Mr. Solomon James and about 115 more panelists from across the country.

In this Writ Petition the following are the Respondents:

a) The Union Of India

b) The RBI

c) M/s Speakasiaonline Pte. Ltd.

d) M/s Haren Ventures Publications.

Under this Writ Petition filed by some independent panelists not by the AISPA the main prayer before the Hon. Supreme Court are as follows:

I. The around Rs. 150 Crores which are seized by various authorities be immediately brought under the custody of the Hon. Supreme Court and as per the orders of the Hon. Court the same be disbursed amongst the panelists.

II. That the respondents No. 3 and 4 i.e. SAOL and HVP be ordered to make payments to the panelists.

The matter is now listed on the 10th October, 2011 for hearing. The Hon. Court has issued notice to all the respondents to file their reply.

Besides these court matters RBI had a meeting with the SAOL officials as informed by the management through the official blog http://speakasiaonlinemarketing.blogspot.com/s

RBI has seeked some clarification and the company will have to revert back to RBI by first week of October, 2011.

In light of the above we can see that the company is facing up to all the challenges and are fighting the system to be allowed to operate in India.

The company’s Business Module is over board and unlike common perception this is not a money circulation scheme nor is it a pyramid recruitment module.

The company’s Business module is way before its time and is revolutionary in content that is why it may be difficult for people to fully appreciate the module clearly.

Speak Asians The Things Are Going Systematically.

The things are going systematically, Any day you may hear a good news.

Every one is depressed, loosing hope and in the pressure of down line.

Guys , some things are need to review ……..

1) EOW has to submit there reports very soon , as per the direction of HC
2) RBI has 2 weeks , but they can put report any day under two weeks and it’s not need to worry about.
3) EOW can’t hand over site , before HC Judgment. It’s Technical term.
4) Exit option is a positive sign and indicates that ,EOW and Court are positive about panelist payments.
5) The communication between Panelist and management is still alive and they are requested us to bear with them.
6) Management lawyers and other officials are active to resolve the things .
7) Now HC, SC and Agencies are involved in this case and any how the things will clear very soon, we are not alone,so please keep calm ,any day you may hear a good news.

And out of all this ,when the things are going systematically not need to do such things which is against the system and the management.

Friends, there three mega events in October, 2011 regarding the court cases of Speakasia. Let us see what are these event, and will this help the company to win and get back?

4th, October

RBI meeting was held with SAOL on 20th September, some queries and documents are asked by RBI, for which 2 weeks time is given by RBI, now SAOL will give results and replies in two weeks to RBI that ends up on 4th october. so it will be sooner. and since RBI is satisfied with the business model and work of SAOL thats why they are further interested to get more things related and will give clearence soon.

 

10th, October

Case is also going on in Hon’ble Supreme court of India, that is from panelists side, its hearing is on 10th october. in it RBI, ROC, MCA are involved. SAOL is represented by one among the top five lawyers in india, Mukul Rohatgi

 

12th, October

Since the Hon’ble judge oh Mumbai High Court is elevated to supreme court of India, thats why our case in Mumbai High Court got delayed by 21 days, due to the fact that durga pooja holidays came during the course…hearing is on 12th october now. in mumbai high court, EOW, ROC and MCA are involved.
Nearly all agencies have finished its inquiry, EOW, ROC, MCA, SFIO, and RBI is doin through meets and documents verification. so in the current scenario, i can assure this only. that if anything faulty or fraudy would have been detected then, neither RBI would have called again for few more things, and also till this time charge sheet against company in various fields and frauds would have been filed, so… its just a matter of some days more, we all will be celebrating our win…as all is in judicial procedure now…it depends on clearence in Courts, and since too much holidays are coming, so hearings are delayed…and things are moving slowly…!!

Good Evening Speakasians,

First of all let me profusely THANK all the panelists who have offered their heartfelt condolences to me in this sad moment.

My family joins me in thanking each one of you personally for the kind words; we acknowledge your love and concern.

The news that the company officials have set up an official E mail (corcom@speakasiamarketing.com) dedicated to answer the queries of the panelists has been received very well by the panelist family. I urge all the panelists to use this important forum to air genuine concerns and for important queries and not flood the E mail with questions like when payout will start or when the website will be functional etc.

I once again wish to place on record that nobody can give a time frame to such things especially when the matter is sub-judice. The company is moving all fronts to see a quick solution of the problem and a fast normalization of the company activities.

We all have read the press note of 19th September, 2011 posted on the company’s official BlogSpot how the much awaited meeting with the RBI took place and how the high ranking committee gave the company representatives a patient hearing. These are small steps but then great achievements have always been started with small steps don’t we remember Neil Armstrong’s (first man on the moon) famous words

"That's one small step for a man, one giant leap for mankind."

In India we always look up for divine intervention and conduct puja’s and havan’s to invoke the blessings of lord almighty. Panelists from Mathura have sent me this mail which is self explanatory:

Good Evening Speakasians,

We all know of the sad demise of Mr. Bahirwani’s mother and I pray that her soul rests in peace. I also request everybody to please do not call him until Saturday i.e. after the chautha ceremony of his mother.

We were all greeted with the good news from the company through the official blog spot www.speakasiaonlinemarketing.blogspot.com. It was good to know that the RBI has eventually given SAOL the opportunity to present to them the Speakasia business module. I am 100% sure that when the company officials return before the RBI within two weeks the RBI will have no problem in clearing the company business model.

There was the Association PIL which was scheduled today in the Mumbai High Court.

As there was a new bench due to the elevation of Hon. Ms. Ranjana Desai to the Supreme Court the court seemed to want some time to understand the case which is a good sign and shows that the Hon. Judge wants to give us a square chance to explain our case. Due to the upcoming Puja Holidays the case is now adjourned to 12th October, 2011 which again is a good date as it will now be heard after the Supreme Court matter which is slated for 10th October, 2011.

All panelists have to understand and realize that in such a surcharged atmosphere even the matter not going against us is a positive sign.

Good Evening Speakasians,

Since the 7th September, 2011 the updates have been very irregular as I have been shunting between Mahim (where I stay) and Mira Road (40 Kms away) where my mother is in the hospital in a critical condition, there is a chance that we may lose her any time now, and if that happens I may not be able to update you, at least for the next three to four days.

Yesterday i.e. 19th September saw the start of a PR exercise by your Association and we addressed a press conference at the Press Club of Mumbai.

I was pleasantly surprised at the huge turnout of the panelists and I estimate that there were almost 1000 panelists outside the Press Club. This also created problems of its own, the area around the Press Club is a sensitive area and we did not want to create a law and order situation so I requested the panelists to disburse from there and to assemble outside the EOW. The panelists most graciously agreed to disburse peacefully.

I think we were successful in putting before the media the view point of the panelists and our concerns arising out of the harassment being meted out to some panelist’s viz. Mr. Dipankar Sarkar, Mr. Vikas Chandodkar and Mr. Ramesh Bachau.

The Association and indeed the entire family of Speakasians are aghast at this change in the stand of the EOW. From being the victims who were being protected we are now victims who are being victimized. Our protectors on whom we had utmost faith have now turned into tormentors.

This current action by the Mumbai Police has left us threatened. We are now scared that this victimization of the victims will percolate into arrest of many more of us.

As you have seen the conference video by now or soon will, you will realize that the media was receptive to our submissions and we hope that they will publish our viewpoint before the readers and viewers.

After the conference we shifted to the EOW and proceeded to submit our memorandum to the Joint commissioner of Police (Crime) Mr. Rajvardhanji. The Commissioner met us for a brief moment as he had to go for a meeting he could not give us a long hearing. We submitted the Memorandum to his office under acknowledgment.

As you must have heard from the various videos uploaded our pleas are quite simple and I list them down as follows:

1. Allow the company, to make payments due to the panelists. The Company is on record and has been repeatedly pleading before RBI and other agencies to be allowed to pay the panelists.

2. Complete the investigation in a set time frame.

3. Pending such investigation the company should be allowed to restart operations thereby ensuring continuous earnings to all panelists.

4. The Mumbai Police more specifically the EOW stops the arrest of the panelists. The panelists have no role in the running of the company or its management.

What amuses me no end is that the basic principal of natural justice is that everybody is to be treated as innocent until proved guilty?

In the case of SAOL the media and all the authorities have already pronounced SAOL to be guilty without even the first charge sheet having been filed. This is CONTEMPT of the highest order. "It seems like a denial of natural justice."

Although we may not be physically with you in India, our thoughts are always with you – our loyal champions. In this hour of crisis that has plagued SpeakAsia for some weeks now, we are most gratified that you have stood by us unreservedly in the midst of all the investigations and false allegations against SpeakAsia.
As you are aware to date, the authorities have not been able to file any charges against SpeakAsia. To put it plainly, our operations are above board and all our transactions are legal. In view of this, we are very confident that it is a matter of time that SpeakAsia will be in full operation in India.
It has come to our notice that some of SpeakAsia’spanelists may be hauled to the police station for questioning over the business operations of our company. This is another attempt to undermine the company through our panelists.
We would like to assure you that SpeakAsia is solidly behind all the panelists and we would urge all of you to stand united in this trying period. As the saying goes, “United we stand and divided we fall”.
Finally, let us reiterate what SpeakAsia’s management has been saying all along. We will overcome all obstacles thrown in our path. Once we are allowed to resume our operations, we will bounce back with vigour.

Good Evening Speakasians,

While interacting with scores of panelists on the ‘Contact us’ page on Aispa, I have come to realize that majority of the panelists still want to know of only the basic issues as follows:

• When will Surveys start?
• When will Payouts start?
• When will EXIT OPTION payments start?

I attempt to answer their anxiety and concerns as follows:

Nobody can give a time frame to such things especially when the matter is sub-judice.

The company is moving on all fronts to seek a quick resolution of the problem and fast normalization of the company activities.

As we all know that the company is being investigated by the EOW.

The Company website is under the custody of the EOW and they are investigating the matter.

Once the EOW is through their investigation the website will be returned to the company.

Only after return of the website, will the operations on the website restart, including surveys, viewing our wallets and the RP’s, till then we will have to remain patient and united.

The company is on record to say that this is the phase where they are collecting data of panelists interested in opting for the exit option. They will simultaneously approach the RBI to seek permission for affecting the PAYOUTS.

The company has further clarified, that they are also contemplating, to deposit the money with the designated courts, or any competent authority for further disbursement to the panelists.

The only thing worth to note is that the company is fighting tooth and nail with the authorities.

We need to be patient and have faith in the company.

Sorry, no time line can be set, but be rest assured that the company is not wasting any time and hopes to solve this problem at the earliest possible.

The very fact, that the company has not vanished into thin air, and on the contrary, hired topnotch law firms to represent their case in the courts, should reassure all of us.

Panelists across the country are now pinning their hopes on 21st September, 2011 which is the next date of the Association’s PIL in the Mumbai High Court, and they ask me what will happen in the hearing on the 21st.

Let me make it clear to all the panelists, that the matter is not in any way posted for any hearing, the matter is posted on 21st for the respondents i.e. the Govt. of Maharashtra, RBI, The Union Of India and SAOL to file their reply. Considering that they indeed file their reply on the 21st then we will have to file our rejoinder (our reply to their reply). Having said this, our counsels will surely try to press once again, and pray before the Hon. High court, that ‘Ad Interim relief’ be given to the petitioners meaning the Association, by safeguarding the payouts due to the panelists.

In the earlier Criminal PIL against the Govt. of Maharashtra, the EOW has been asked to file their affidavit detailing the preparedness of the state in preventing cyber crime. Besides this, the EOW has to submit their report on the meeting with the Addl. Commissioner (Crime), with the forensic expert who had preferred an intervening application on the last date.

In both the matters there are no arguments expected.

Save and except the prayer of the Associations counsel no other move is expected in the Associations PIL.

I hope you are all aware that in the Writ in the Supreme Court the respondents are to file their reply before the 24th September, 2011 and the actual hearing is scheduled for the 10th October, 2011.

Yesterday, i.e. 16th September, 2011, the panelists in Delhi who have filed the WRIT PETITION in the Supreme Court, had held a Press Conference, and according to reports, it was a positive interaction with the press, and they have managed to put across to the press the view point of the panelists.

Your Association is also organizing a press conference on Monday, i.e. the 19th September, 2011, at the Mumbai Press Club, Mumbai, where we hope to put across the Panelists view point before the media.

Let us all hope and pray that the view point of 20 lakh panelist citizens is indeed put forth in the public domain without any malice and in an unbiased manner.

“Khisiani bili…. Khamba noche”

The above proverb roughly translates as follows “a frustrated cat… starts scratching the pole” (in vain).

I was forced to start this update today with the above proverb after reading various news items which were not only factually incorrect but in most case was an attempt to place before the readers/viewers old wine in a new bottle. This is the case of churning out old news in new packaging. Was this an attempt of a frustrated adversary?

NO 150 panelists have been arrested anywhere in India. The news of scores of accounts having been frozen is actually very old news which the media is trying to put across as new seizures. We all know that almost 150 crores were seized from various Panelists’ and franchisees accounts sometime in the month of July arising out of the Vijayawada case and the Khosla case in Mumbai. After that no bank account has been frozen by the authorities.

There was news carried by media, announcing that a consignment worth over 1000 Crores was seized by the customs authorities, this again is very old news, I just cannot fathom or cannot see any reason why the media has resorted to this recycling of news. In good old times one publication would never run a news item published by another but then like ‘shudh ghee’ is not available nowadays, even shudh journalism seems to be nonexistent.

I ask myself a few questions. Why over the last couple of days have the Speakasian Panelists been bombarded with so much disinformation about the impending investigation of individual panelists by the authorities and the seizing of their accounts? Is it to spread panic amongst the panelist family? Is this a desperate attempt by the enemy to influence the authorities against SAOL?

I ask myself, has there ever been a case in the history of independent India, when employment has been generated for over 20 lakh people within a short period of 10 months, has this ever been done by any Government, semi Government, or any NGO. Then why try to stop a revolutionary module like the business module of Speakasia.

I ask myself, how is SAOL a fraud that it is been made out to be? Here is a company which had regularly paid their panelists without fail till 12th May, 2011. The company has not been able to pay their panelists since 12th May 2011, not because they do not want to pay, but because they are not being allowed to pay. What amuses me no end is everybody wants to hang SAOL by the first visible pole without even trying to understand the revolutionary business module. The only crime that SAOL has possibly done is that they have been ahead of their time, much ahead.

Here is a company, which has been approaching various authorities including RBI, requesting them, actually pleading with them, to be allowed to make payouts to the panelists but alas all such requests seem to fall on deaf ears.

The funniest part of this comical circus is that the entire case of the EOW is based on one, YES ONE, solitary FIR filed by a disillusioned individual going by the name of Mr. Khosla who had purchased subscriptions amounting to approx 5 lakhs or thereabouts who has earned almost one lack sixty thousand or thereabouts regularly upto 12th May, 2011. Please note that it is not his case that he was not paid before 12th May, 2011. His case is that since 12th May he has not been paid. I ask Mr. Khosla and everybody how can anybody be paid if all banking channels have been frozen up post 12th May 2011 pursuant to the aggrieved cautionary RBI circular dated 23rd May, 2011.

I ask myself, what could have been the possible material before the RBI, to have in the first place, circulated such a circular. Has the circular been circulated after application of mind? I hope it is not a result of a hallucinating mind. This has unfortunately resulted, in robbing over 20 lakh Indian citizens, of their basic right to seek gainful employment and is in gross violation of their basic human rights.

Here is a classic example of a person who strangulates you and continues to slap you because you cannot sing melodiously. I ask myself, how on earth can I sing if I am not allowed to even breathe?

Wow!! This family of proud Speakasians surprises me no end. Every day I am introduced to the resilience of this family, the unity amongst the panelist and the solidarity for a company i have never seen before in my existence of 51 years.

Just to give a small example this is a mail we received from someone in Bangalore and I quote:
“Before I joined Speakasia I lived a life full of hardships and ran around to make two ends meet. My family luxury was to have three meals. Today my Bank balance is almost 18,00,000/- and I want to donate this to Aispa. Order me how to give this donation”

I replied by saying, “bas bhai rulaaye ga kya”. I declined his magnanimous offer by advising him that although his offer has been well appreciated, reminding him of his earlier days, I advised him to be careful with his money and that he should invest the same for his young child’s future.

The Association for the first time since its inception made a soft appeal for monetary help, to some panelists, and the response took me by surprise, I was inundated with phone calls from all over offering help. I was filled with wonder at the faith and generosity of Speakasians even after not having received a single naya paisa over the last four months.

The Association made this appeal for funds for two major initiatives i.e. a) The development of the Aispa site and b) the upcoming PR exercise. Each and every contribution will be issued a stamped receipt and the entire statement of accounts will be put up on the aispa.co.in website every quarter.

The recently introduced EXIT OPTION has raised many doubts amongst the panelists. Today I attempt to answer their questions as follows:

When will we get payment, if we apply for the exit?
A. The company is on record to say that this is the phase where they are collecting data of panelists interested in opting for the exit option. The Company will simultaneously approach the RBI to seek permission for affecting the transfers, the company has further clarified that they are also contemplating the option of depositing the money with the designated courts or any competent authority for further disbursement to the panelists. This shows the resolve of the company to ensure that the payments to all its panelists are effected on TOP PRIORITY.

Q. I have filled the EXIT APPLICATION. I have not got any confirmation E mail?
A. We all know that the company’s original website www.speakasiaonline.com which has all the data of the entire speakasia panelist is in the custody of EOW and is being investigated by them. Once the website is handed over to the company the company officials will then verify all the details from the EXIT APPLICATION and after such verification the verification E mail will be sent to the Panelists.

Q. The Panelist has taken part in the activities of the company and has earned RP’s more than the subscription cost but has not encashed any RP’s. If I want to exit now will I get refund of my entire subscription cost?
A. Yes he will get full refund; the refund does not depend on the balance of RP’s in the various wallets. The refund policy is quite clear; the refund will be affected in the following manner. Total cost of Subscription = Rs. 10000 (remember Rs. 1000/- is registration cost) less total amount earned and encashed.

Q. After entering all the fields in the exit option I pressed the bottom line ‘continue’. No further continuation. No acknowledgment mail received.
A. As per my information as soon as you hit the continue button at the bottom of the exit application page you get a confirmation message next to the continue button itself saying that your application is received.
We should appreciate that as the website is with the EOW, the company officials are unable to verify any details, and they are just collecting data as of now. Once, the site is handed over to the company, I am sure they will confirm the details. The continue button at the end of the page may be modified to submit soon.

I wish to remind all the panelists that the company is serious in normalizing the entire operation and the company is probing at all possible avenues to ensure that the payments are given to the panelists immediately without any delay.

Panelists need to remember that this business module of Speakasia has been a life changer in many a life’s and it has changed the living standards of scores of panelists.

Good evening Speakasians,

“Silence they say is louder then noise… it takes silence to make noise”

Friends, I know how it feels when our mind is curious to know and no input is available. There is so much information doing the rounds, some good some bad, we do not know what to believe and what to reject, we want answers and what we get are more questions… uff… the silence is unbearably deafening.

The EXIT OPTION has been received with mixed reactions by most of the panelists. Panelists who have implicit trust in the company were elated to know that their beloved company has once again stood the test of time and proved beyond doubt that the company is here to stay with a long term vision. This act of the company has left the doubters in shock as to how this company, whom they had doomed to go to the gallows, could take this righteous path and prove to be genuine beyond doubt.

The wailers, who were shouting from the roof tops and baying for blood, were thrown down the valley of doubt asking themselves, if the route of EXIT was in fact the correct decision to take. The responses from some diehard opponents was nothing short of being comical, from the stance “I am smart I will take the exit option the minute it is announced”, to “chalo thoda aur time dekh lete hai, exit toh kabhi bhi le lenge”.

By offering the EXIT OPTION the company has passed the proverbial “agni pareeksha” but who is to stop the doubters from doubting pure gold for impurities.

As the secretary of AISPA I am privileged to have interacted with scores of proud Speakasians. The love and affection being showered on the company by this magnificent family of Speakasians is unbelievable and I am deeply touched.

Whilst concluding my yesterdays Update, I had expressed my anxiety, at the authorities getting personal and hitting out at the panelists to try and get some matter against the company (SAOL).

The only advice I wish to offer the panelists, is to stay united together, in such trying times.

Remember, that all the panelists are united, and AISPA is firmly behind each and every panelist and we are prepared to fight for our rights and we will not bow down in submission. If SAOL can fight so hard, we the panelists can fight too.

Know for sure we are on the side of righteousness and we all know as Indians that in the end analysis “satyamev jayate” Truth is all encompassing, TRUTH will prevail.

For the authorities trying to pull us down I wish to say:

Good Evening Speakasians,

Thank you all for having allowed me the much needed holiday with my family to celebrate the Ganesh Maha Utsav.

Unfortunately on 8th September, 2011 my mother had to be admitted for severe Pneumonia which later progressed into multiple disorders. She is stable now and my entire family prays that she is able to win this battle and come back home safe.

Loads have happened since I wrote last on 6th September, 2011 and our President has covered almost all issues including the great news of the EXIT OPTION.

Today our Global CEO Mrs. Harender Kaur wrote on the official Blog about the genuineness of the website of the company i.e. www.speakasiamarketing.com I sincerely hope and pray that with this communication from our chairperson any question or doubt about this company initiative is finally put to rest. I request all the panelists who wish to opt to take the EXIT OPTION should go to this new company website and fill out the EXIT APPLICATION.

Mr. Melwyn Crasto, President, AISPA., in his last update had pointed out the company’s resolve to ensure that the panelists opting for the exit option are paid without further delay even going to the extent of depositing the money in any designated court or any competent authority so that the panelist are paid out without any further delay.

Speakasians I wish to draw your attention to the fact that this is probably the first time in history of publication that a company is agreeing to refund subscription costs to a subscriber after the subscriber has paid up the subscription cost for a stipulated period. This goes a long way to show the absolute genuineness of SAOL. With this decision I feel all doubt should be put to rest about the long term goal of the company.

During my interaction with panelists personally and on reading the queries of many a panelist through the CONTACT US on aispa.co.in I have drawn out some common questions of panelists as listed below:

1. I do not remember the exact joining date? I only remember the month and year but not the date?

ANSWER: In this case you will have to wait for the company website to get operational before you can opt for the EXIT OPTION, unless the company modifies the EXIT APPLICATION and makes this field not mandatory.

2. I do not remember the Sponsor ID? My Sponsor does not remember which account they sponsored me through?

ANSWER: In this eventuality you will have to await the website to get operational again. The company I am sure are aware of these issues by now and they may modify the EXIT APPLICATION or may allow all fields to be not mandatory.

3. I have not uploaded my Banking details? I do not have a bank account?

ANSWER: This is in gross violation of the company’s norms or terms of agreement and I am sure you will have to wait for the restarting of the website and only after uploading the banking details you will be able to get any sort of refund of your subscription cost from the company.

The steps being taken by the company are uplifting the confidence of the panelists and the panelists are now feeling secured in the association with the company.

What worries me now is that as the authorities are seeing the company take solid positive steps towards normalization I hope and pray that the authorities do not start taking a stance of hitting below the belt and start harassing the panelists.

Once again I appeal to all Speakasians to stand united, have faith in the company, and have patience.

The entire family of Speakasians is on the verge of a memorable victory I wish to recount an explanation of a panelist from Hyderabad of the present situation as below:

“We all are sitting in an airplane whose engines have been shut, that is why we are all sweating….

First of all, let me on behalf of the entire committee; CONGRATULATE the entire Speakasian family on the “EXIT POLICY” announced by the company’s website: http://www.speakasiamarketing.com

There have been various questions raised by many panelists on the methodology of the EXIT OPTION and its implementation. Let me explain the entire process as I understand it.

I draw my information from the official communication of the marketing team dated 5th September and 9th September, 2011 and from the Exit Policy Document as posted on the new website of the company.

First and foremost I wish to put to rest any debate or doubt raised on the authenticity of this initiative. I place on record that this blog and now the website both these platforms are indeed the company’s (SAOL) initiative and we should not doubt this in any manner. I and Mr. Bahirwani have both confirmed this fully and we are both sure that this is indeed a company initiative and there is no doubt about this.

The company’s communication from the above referred documents is abundantly clear that this is an exercise by the company to gather information from the panelist’s on their intent to exit so that once the banking channels are in place these EXIT OPTIONS can be processed and cleared without any further delay.

Pertinent to note here, and allow me to draw your attention, to the fact as mentioned in the second last para of the EXIT POLICY document and I quote “(Alternatively the company is also actively exploring the possibility of transferring the total amount along with the list of recipients to either a designated court in India or a competent authority that the court may wish to appoint for this purpose.)” end quote.

This shows the resolve of the company to ensure the payments to its panelists at whatever cost and through the fastest available route.

Is this the action or response we expect from a company on the run?

No, this is the response from a company who is very clearly here to stay and grow along with its panelists. The intention and resolve of the company is crystal clear for all to see. With this EXIT OPTION the company has put to rest all doubts of its genuineness.

I now attempt to explain the POLICY.

a) Panelists who have not earned any RP’s what so ever can exit from their association with SAOL and get the entire subscription cost of Rs. 10000/- or RP 200 refunded to them in full into their banking account as registered with the company.

b) Panelists who have earned some RP but have not encashed any RP will also get the entire subscription cost as mentioned above.

c) Panelists who have earned RP’s and have encashed part of their RP’s will get refund of their Subscription less the amount encashed either by way of direct cash requests or through generating Pins etc.

d) Panelists who have generated revenue more than their subscription cost are welcome to participate in SAOL website, since their participation has earned them RP's more than their subscription cost. They can now utilize the RPs for various revenue generating activities of the company once restart of SAOL activities are allowed in India.

I hope I have been able to clarify any doubts about the “EXIT POLICY”

EOW was not present only ROC & MCA officials was there and they request for another 14 days to complete the investigation process , this is the final extension given to these agencies , until now no proofs of any type of fraud proved. This is the PIL hearing of AISPA, hence it will not effect any type of proceedings of SAOL , which legal team is doing .

SAOL Case

Great news for all of us. EOW was not present in High Court today(due to some confidential reasons), so the Lawyer of EOW is adviced that this matter could be solved by mutual talks, and they have to sit and talk with SAOL, and make sure to start payments to the panelists as soon as possible.

I was once again watching the video of the Headlines Today report on the Supreme Court matter of the 2nd September, 2011. I am really pained at the way the channel has reported this entire matter in a malicious and provocative manner.

No Supreme court Judge can ever make such prima facie observations like “You have defrauded thousands of people” and “Investigations against you must continue”.

WHY? Because as of today there is not even a single charge sheet filed against the company (SAOL). Further Headlines Today reported that the Hon. Supreme Court had “dismissed” Saol’s petition where as the fact of the matter is that the petitioners (SAOL) had on their own will “withdrawn their petition”. In Law there is a very big difference between these two terms.

The withdrawal of petition by the companies (SAOL) counsel was a strategic move to keep their route in the Hon. Supreme Court alive.
It is the hallmark of an experienced Counsel to quickly gauge the mood of the Bench.
It is unbelievable, a blatant lie by the channel, to even suggest that the Hon. Supreme Court can make such an observation. The Order of the Hon. Supreme Court is in the public domain and everybody can see the same.

Nowhere in that Order has the court made any Observation or passed any order even close to what the channel has reported. This constitutes contempt of Court of the highest order.

AISPA is going to strongly lodge a protest against this misreporting, I did not want to disturb our Associations Counsel Mr. Adv. Ahmad Abdiji it being a Sunday, but by tomorrow evening I will surely lodge a complaint against the channel in the right forum as may be advised by our counsel.

Your Associations website is under up gradation and the fully functional website with all features like chat and interactive forums will take about a week to be fully uploaded. Please bear with us till then. I am sure you will appreciate this modern and high end website once it is fully operational. It is our endeavour to provide all the panelists with a properly moderated yet independent and open forum for them to exchange views, ideas and to share their concerns as a member of AISPA.

There were reports that a rogue site speakasiaassociation.in has surfaced claiming to be the official website of AISPA. I want to refute this and place on record that this site is no way connected with AISPA. We are looking at the possibility of serving them with legal notices. Good Evening Speakasians,

We all were pleasantly greeted with the news that speakasia management had started a blog for communicating with the panelist

Like everybody I was also thrilled and welcomed the pleasant news and appreciated the attempt of the company to open up a channel of communication with the panelists.

But my critical mind raises a few doubts on the authenticity of this Blog being the official medium of the company. Here is why:

1. The first post on the Blog is dated 12th August, 2011 suffers from a serious error. The author states in the blog that the Mumbai High Court had heard the bail application of Tarak Sahib and was pleased to deny extension of police custody. We all know that the Bail Application was heard by the Hon. Magistrate Court at Esplanade Court (Quila Court). I am sure if this was indeed an official Blog by the company for communicating with the panelists such a major mistake would not have occurred.

2. If indeed this is a company initiative then why after the first post on the 12th August, 2011 did the company remain silent for all these days. They should have attempted to popularize the Blog from 12th itself, the panelists have all been waiting for some sort of official communication and everybody would have been surely happy to welcome such an initiative of the company.

3. This also now raises doubts on the authenticity of the letter of Mrs. Harendar Kaur. Was the letter planted by the same authors of the Blog? We have all read various communications of Mrs. Kaur and we know her to be an articulate writer the current letter has grammatical mistakes and spelling errors.

4. I know many panelists have got some sort of confirmation from the SAOL officials but then maybe they themselves have been misguided.

I want to be proved wrong this time and I hope all that is written above is wrong and this entire exercise is indeed of the company.

During my interaction with various panelists from across the country I have come across major mistakes people have committed in their quest to have signups which is now leading to trouble, I wish to share these errors with you so that in future these mistakes are not committed you will realize that these mistakes have been committed by people who had implicit faith in the company and these steps were taken as a short cut to reach huge numbers.

• I know of people who have given personal post dated cheques to their direct sponsored downline equaling to the amount that the joining in panelist paid for the subscriptions. Why will someone do something as stupid as this? How are you personally responsible for the decision taken by the panelist after having fully satisfied themselves after hearing the SAOL business module?
• Some people have signed affidavits giving personal assurances to the panelists on the safety of their Monies. This is also going one step too far.

Having implicit trust and faith in the company is one thing, going absolutely over board is another.

These are the kind of panelists who have used the term “Investment” which has become our nemesis. This word is nothing short of committing blasphemy against the company and its revolutionary business module.

One other important complaint I hear across the board is that up lines do not answer the phones of the downline. Leaders have all gone unreachable. Many leaders have changed their numbers and are not approachable. This is what has angered the downline especially the panelists who joined after March-April and have not received any payouts and they feel cheated.

Just to give a personal example, not that I want to brag about my efforts, since I have become the secretary of the AISPA and somehow my phone number has found its way into the public domain I have been flooded with hundreds of phone calls from across the country and I have answered each and every phone call, even called back the missed calls this is the kind of proactive interaction the downline expects from their sponsors and the leaders whom they have looked up at when they joined this revolution called Speakasia.

We need to understand that we are associates of an international company which has always professed absolutely clean, honest and professional conduct. We need to match this corporate philosophy of SAOL and prove without doubt what it actually means when we say “Proud to be a Speakasian”

I urge all panelists’ brethren to draw inspiration from our company top honchos.
Learn from the vision and courage of our Chairperson and Global CEO Mrs. Harendar Kaurji; imbibe the coolness and articulation of our CEO Mr. Manoj Kumarji, wear the Tiger spirit and never say die attitude of our inspirational and beloved CEO Mr. Tarak Bajpai, take a lesson from Mr. Narayanan’s aggressiveness and his eye for detail, if we are able to even include some degree of all these qualities in our selves we will be a changed person and then I am sure we will be true leaders and a catalyst of change in our own and in the lives of people whom we touch.

Good Afternoon Speakasians,

The news from Supreme Court was once again reported in a negative manner by the media across the board.
Our Counsels preferred to withdraw the petition; the court was pleased to pass the following order “Petition Withdrawn by the Petitioner”.

The media is reporting this order as if the Court has dismissed the Petition or passed any strictures against the company. The Petition has been strategically withdrawn by the company on its own will.

Headlines Today have maliciously reported that the Hon. Supreme Court has said that SAOL has defrauded thousands of people. I hold Headlines Today to this and demand them to submit proof of this observation of the Hon. Supreme Court and I am separately writing to them seeking clarification or in the absence a correction statement.

The Petition was heard by His Honorable Mr. Justice Markandey Katju and Honorable Mrs. Justice Gyan Sudha Misra in the Honorable Supreme Court.

The Judges were of the opinion that the Petition was before time, and while the matter is being investigated, it would not be proper for the court to club the matters together. The court was of the opinion that the matters can be clubbed together at the trial stage i.e. after the charge sheets have been filed.

Sensing the mood of the learned bench our senior Counsels strategically decided to withdraw the Petition.
PERTINENT TO NOTE HERE IS THAT NO NEGATIVE ORDER OR COMMENT WAS PASSED BY THE HON. JUDGES WHICH IS A GREAT RELIEF IN ITSELF. 

This keeps our route open and we can always go back to the Supreme Court if some fresh issues develop or if we come up with some fresh grounds.

Please understand that there was no other Petition before the Hon. Supreme Court from the company SAOL save and except this present Petition.

There was no anticipatory bail Application. The Petition of the company was to the effect that all investigations be clubbed together under one investigating agency.

Remember the PIL preferred by some individual Panelists is ready for filing in the Supreme Court and is expected to be filed tomorrow, if the petition is filed tomorrow then we can expect the Supreme Court PIL to be heard on Wednesday.


Also remember that the hearing in the Association’s PIL before the Hon. High court at Bombay is also on Wednesday i.e. 7th September, 2011. To refresh your collective memories the Hon. High Court had asked the Maharashtra Government to file reply to the PIL within Two weeks which ends on Wednesday i.e. 7th September, 2011.


I do not see any end of road arising out of this withdrawal of our petition in the Supreme Court today.
In my experience with the legal process I have seen such stepping back many a times only to bounce back with more energy. I have been informing all of you that this is not an easy situation to be in but important to note here is that we are moving in the right direction.

Good Evening Speakasians,

First of all, on behalf of the entire committee: Eid Mubarak.
As all the courts were closed today there is actually not much to update you on any new activity.

I take this opportunity to update the speakasian family of the current situation and offer an overview and look at the roadmap ahead.

In my interaction with so many panelists over phone, thru E mails and also on various networking sites related to Speakasia, I have sensed that majority of the panelists have unflinching trust in the company but they are getting a little impatient now as they have not heard any “thok” good news. To make matters worse they cannot see their E wallets and the Survey wallets and cannot see their RPs. Of course the under lying concern about the long term fate of the company and their pay outs are naturally evident.

It pains me no end to see the extent of Human Right Violation of the panelists basic right to earn livelihood and all this not because the company has run away but alas because of the insensitivity of the system combined with negative and biased malicious campaign by the media.

The entire contradiction hits me hard when I hear, read and understand that across the board, all authorities talk of safeguarding the monies of the small and marginal “Investor” but in fact they are not taking the simple logical step that they should take immediately, which is to allow the company, which is shouting itself hoarse, and approaching the RBI repeatedly, to allow the company SAOL to make the payments.

“Sujag, soye hue insaan ko koi jagaa nahi sakta”.
Senior counsel Mr. Ram Jhetmalani has gone on record to say that the media is guilty of the highest degree of contempt of court because due to their unsubstantiated negative reporting they are in fact biasing the judiciary and the powers that be.

The media is guilty of doing everything else other then actually reporting.
Clean Journalism as I know hears both the sides, does their research and puts across their findings/report in an unbiased manner before their reader/viewer for them to judge.

But in today’s time the exact opposite is unfortunately being done. What has sadly become the norm of journalism today is that the media pick up one side of the story and report it without doing any sort of research without taking into consideration the other side’s view and assume the office of the judge and report the matter along with the judgment.

They hang the accused from the first tree.
They are the investigator, the prosecutor and the judge all rolled into one and journalism is nowhere in sight.

The latest example of unsubstantiated reporting was seen in the matter of reporting the Hon. Hyderabad High court, the hon. Justice transferred the matter to the state CID for thorough investigation and the media reported that the Hon. High court had ordered the CID to make any arrest as they feel good.

The company’s application before the Hon. Supreme Court prays that all matters relating to this one single case of SAOL be transferred and investigated by any agency the court feels is competent to investigate. That the Investigation be completed in a set timeframe and pending the outcome of this investigation all further arrests be stayed. If the company manages to get relief from the Hon. Supreme Court then all the matters including the Andhra Pradesh matter will be transferred to one investigating agency that the court feels fit for this investigation.

On the matter of the SAOL site, I wish to bring to your attention that the site is facing technical problem but it cannot be rectified only because the admin rights are with EOW. As no senior official is available to go to the EOW to take custody of the web site even if the investigation is completed.

Last but not the least I wish to remind all the panelists that we are faced with a serious problem and although we will taste the ultimate victory “satyamev jayate” these kinds of complicated issues take some time to get normal. Although I am sure that we all will start hearing GOOD NEWS starting from early next week, normalization of operations will take some time and payouts will start only after the operations normalize.

“Humara babbar sher pinjre se bhair nikalte hi, sabhi morche khol dega, aur unki furthi se jald se jald, poore current situation ko humare haq mein mod dega”.
Let us all continue to trust the company, let us remain patient. We will surely win.
